Q: I’m married, does my spouse need to come to closing?

Your spouse will need to be present if your spouse is on the deed for the subject property.

If your spouse does not hold title but resides in the subject property, your spouse must come to closing.

Your spouse will need to be present if your spouse is a co-borrower on the new loan.

If your spouse does not hold title and does not reside in the property (i.e. investment property), your spouse may not be required for closing.

Q: I'm doing a cash-out refinance today, will I get a check today?

If you're refinancing on your primary residence, your transaction will not fund or disburse until the rescission period is over (three more business days--Saturdays may or may not be included).

If you're refinancing an investment property, there is not a rescission period so your transaction should fund the same day as your closing.

Q: What is a Rescission Period?

A rescission period is a three-business-day waiting period from the time the final loan papers are signed to the time the transaction disburses in accordance with federal law. The customer can cancel the loan without any penalty during this period.
